The ABA recently modified Model Rule 1.10 to enable law firms to screen conflicted lateral hires. Under the new Model Rule, an attorney joining a firm that currently represents a party adverse to his or her former client can be screened without obtaining a waiver from the parties involved. Importantly, in order to avoid disqualification, the attorney must be screened in a timely manner and the firm must provide written notice to affected parties and demonstrate compliance with the expanded screening rules, which set standards for screening timeliness, effectiveness and ongoing notification.
